Discipline Management Plan
Level 1
Offenses include, but are not limited to the following:
(Second offenses will result in a Level 2 consequence).
*Cheating/copying the work of another 
(Cheating /copying may result in a grade penalty and disciplinary action to be determined by the teacher.) 
*Eating and/or drinking in an unauthorized area
*Teacher discretion for food and drink in the classroom should be used.
*Failure to bring books/supplies to class and/or do assigned work
*Horseplay and/or running in the halls, cafeteria, or classrooms
*Loitering, either in an unauthorized area, or on campus after school hours
*Misuse of pass
*Public displays of affection are limited to holding hands
*Violation of published classroom rules and/or procedures established by the teacher
*Unauthorized use/possession of a CD/tape player, radio, or recorder:
(At the discretion of the teacher, CD/tape players, radios, and recorders may be used for educational purposes within the classrooms. 
Students shall, however, keep these items in their book bags until they are in the classroom in which the use is authorized.)
*Wearing a hat, bandanna, or any type of headgear in the building
(Headgear must be kept in the locker during school hours and must not be removed until departure from school. 
Failure to follow this policy may cause the item to be confiscated by any school employee and turned into an administrator.)
*Violation of playground rules
*Possession of unauthorized toys
*Forgery and/or falsification of a school document:
*Excessive tardiness
*Dress code violations
*Disturbance in class, hall, cafeteria, or elsewhere on school grounds
*Profanity, vulgar comments, vulgar gestures and/or drawings
Procedures:
1. Intervention shall occur by the teacher who is supervising the student or who observes the misbehavior. 
2. Repeated violations shall result in a more severe response. 
Consequences: 
Disciplinary actions shall include, but not be limited to:
*warning/reprimand
*conference with student
*withdrawal of privilege
*classroom isolation
*teacher assigned detention
*and parental contact
Level 2
Offenses include, but are not limited to the following:
*Continuation of Level 1 offense
*Bus disturbance (Additional information is provided in the School Transportation handbook).
*Engaging in threatening behavior and/or encouraging, promoting, or inciting violence
*Gang-related drawings, signs, verbal comments and/or gestures
*Fighting
(A fight is defined as two or more people intentionally causing physical contact with each other in an aggressive manner.  Fighting will not be tolerated at Janie Stark and will result in being suspended for up to three-days).
*Insubordination
*Leaving school/class without permission (Leaving class without permission is considered insubordination/truancy.)
*Misbehavior at a school-sponsored activity
*Possessing, smoking, or using tobacco products on campus or at any supervised school activity
(Tobacco products, including lighters, matches, and flints will also be confiscated.)
*Possessing any laser-pointer or knife. (Any laser-pointer or knife will be confiscated.)
*Sexual harassment (Defined as intentionally, knowingly, or recklessly making lewd sexual comments or gestures.)
*Absenteeism, Truancy, and Skipping:
(A child between the ages of 6 and 18 – depending on when the child’s birthday falls – must attend school each day during the instructional year unless exempted by law. A student enrolled in Kindergarten or pre-kindergarten must attend school. [Education Code 25.085(c)])
*Violation of clinic procedure (For further information, please see the District Student Handbook.)
*Vandalism (Defined as damaging or defacing another person’s property or school’s property.)
*Verbal abuse, racial slurs, and/or derogatory statements
*Theft
*Failure to serve school consequences
Procedures:
1. Refer violations to an administrator
2. Disciplinary action will be based on previous actions and/or the seriousness of the offense.  Repeated violations shall result in a more severe response.
Consequences:
Disciplinary actions shall include, but not be limited to: after school detention, In School Suspension (ISS) placement, suspension, work detail, withdrawal of privilege, and/or legal action.
Additional Misconduct
*When a student has engaged in behavior that might result in AEP placement, he/she may also be suspended for up to three days pending a conference between school administrators and parents to discuss that possible change in placement.
Procedures:
1. Refer to District Student Code of Conduct for other violations. 
2. Additional information regarding the offenses that result in placement at the Alternative Education Program (AEP), expulsion, procedures, due process, conferences, hearings, and appeals are stated in the District Code of Conduct.
Consequences:
Disciplinary actions shall include, but not be limited to suspension, AEP placement, expulsion, and legal action as indicated in the District Student Code of Conduct.
